he killed you and got off easy because of “gay panic”

Did you know that if you are gay/trans and are killed by a straight male,
he may get off from seeing any jail time because of something called the “gay panic defense”?

shocking,
right?
bet some of you didn’t know this as i didn’t.
i learned about it while watching the last episode of “last call: when a serial killer stalked queer new york” on max.
during the hyena’s first murder in college,
where he killed a gay male and dumped him in the ocean,
they used that defense that allowed him his freedom.
if they would have hauled his ass to prison in 1973,
he wouldn’t have gone on years later to brutally murder other gays.

The gay panic defense or homosexual advance defense is a strategy of legal defense, which refers to a situation in which a heterosexual individual charged with a violent crime against a homosexual (or bisexual) individual claims they lost control and reacted violently because of an unwanted sexual advance that was made upon them. A defendant will use available legal defenses against assault and murder, with the aim of seeking an acquittal, a mitigated sentence, or a conviction of a lesser offense. A defendant may allege to have found the same-sex sexual advances so offensive or frightening that they were provoked into reacting, were acting in self-defense, were of diminished capacity, or were temporarily insane, and that this circumstance is exculpatory or mitigating.

The trans panic defense is a closely related legal strategy applied in cases of assault or murder of a transgender individual with whom the assailant(s) had engaged in or was close to engaging in sexual relations with and claim to have been unaware that the victim was transgender, producing in the attacker an alleged trans panic reaction, often a manifestation of transphobia. In most cases, the violence or murder is perpetrated by a heterosexual man to a trans woman.

Broadly, the defenses may be called the “gay and trans panic defense” or the “LGBTQ+ panic defense”.

when i heard about this,
it brought chills down my spine.

It made me imagine all the hyenas who might have killed me because of “gay panic”.

the ones who blatantly pursued me but after intercourse,
might have flipped tf out when post-nut clarity set in.
thankfully,
they can’t use it in new yawk but it made me fear other foxholes.
there are so many laws and loopholes that work agaisnt being black,
but add being gay/trans into the mix and it’s a whole mess.

  1. I don’t think people realize this justification exists in certain states but it should be struck down by federal legislation, so it’s something to put in our Congresspeople’s ears. There are a number of LGBTQ Congresspeople now, House Reps and Senators, so one of them could and should introduce this in each chamber and then press Biden to sign it into law.
